Trespassing
Case Summary:
The defendant was charged with a single count of Criminal Trespass 2. The charge resulted after the defendant went through a gate to view a property that was for sale. There were several no trespassing signs located around the property and a realtor sign indicating that an appointment was needed. The defendant ultimately pled to a violation and paid a $150 fine.
Attorney Comment:
"For those who've read other summaries you should know by now that when the government is willing to resolve a criminal case with a plea to a non-criminal charge it is exceptionally difficult to pass-up. This was already kind of a weak case but, from a strictly technical stance, what my client had done was probably illegal. So faced with the prospect of the cost of a trial my client opted to plea to a violation (not a crime) and pay a modest fine to have the case be done."
