"My client adamantly denied being involved in any type of racing behavior. After reviewing the citing officer's body camera it was apparent that the officer had engaged in a poor investigation of the case. This occurred because the officer's star witness was an off-duty cop so the citing officer didn't do any investigation and simply just took the off-duty cop's word regarding the entire alleged incident. At the trial we were able to sufficiently impugn the citing officer's credibility regarding his investigation. At the trial it became clear that the State had failed to turn over all discovery prior to trial. During the middle of the trial we moved the Court for a dismissal of the case based on discovery violations. The judge agreed and dismissed the case mid trial."
Be advised that I never promise a client a particular outcome, details of prior cases should not be taken as an indication that other clients will necessarily see the same results.
