The defendant was charged with assault and harassment x 2. The defendant was a security guard employed to provide security services for a local business. The allegation was that the defendant had assaulted and harassed two people while he was placing them under citizen's arrest for trespassing on the property.
"This was a case of classic officer bias. The local police department had a strained relationship with my client. When they arrived on the scene in this case, after my client had requested assistance, the officer immediately begin treating my client as the suspect. The police ignored an incredible amount of evidence showing that my client was justifiably placing these two people under citizen's arrest. At trial we were prepared to show that one of the people had entered the business and committed theft and, in all likelihood, was manufacturing drugs in the restroom of the business. Finally, the officers were ignoring known criminal activity being engaged in by the other person so that they could try to keep the integrity of the case against the person who they had targeted (my client). The case was dismissed the morning the jury trial was supposed to begin."
