Running Cars Off the Roadway
The defendant was charged with a single count of Reckless Driving. The charge resulted out of an incident where the defendant was alleged to have been driving on the freeway in an extremely reckless fashion. The citizen witness alleged that the defendant was running cars off the roadway and speeding. The case resolved with a plea to Careless Driving and the defendant was ordered to pay a fine.
"After reviewing the discovery in the case there were some substantial holes in the State's evidence. On top of that my client denied driving in the fashion the witness described. Interestingly enough no other motorists on the road that day called in to report my client's alleged reckless driving, including the alleged motorist that was run off the road. The fact no one called from that vehicle, or any other vehicles, tends to discredit the only reporting party of my client's alleged behavior. After discussions with the district attorney we were able to negotiate a violation resolution. Due to the uncertainty of a trial outcome my client opted to accept the negotiated resolution and pled to a non-criminal violation and to pay a fine."
