Menacing and Criminal Trespass
Case Summary:
The Defendant was charged with a count of Menacing and a count of Criminal Trespass. The charges arose after the Defendant followed behind another vehicle that had been on the Defendant's property. When the other vehicle stopped, the Defendant got out and confronted the occupants of the other vehicle about them having been on his property. During this encounter the Defendant was carrying a rifle. The Defendant pled guilty to a violation and had to pay a fine.

"This was an interesting case. My client had been plagued by trespassers on his property for years. He had taken great efforts to try and avoid being victimized as people repeatedly trespassed and vandalized his property (entered his property and committed theft, etc). On this particular day the vehicle that entered his property were individuals who were slightly lost and looking for a friend's house. Imagine their surprise when they finally reached their destination and they were confronted by my client (who had a gun) and began interrogating them in a hostile fashion. This wouldn't have been a great case to put in front of a jury, but my client didn't have any criminal history and after we were able to get many letters of recommendation about the kind of person my client was, we were able to negotiate a non-criminal resolution."
