Fighting a Speeding Ticket from a Traffic Camera
Case Summary:
The Defendant was charged with a speeding violation from a traffic ticket camera at an intersection. The ticket was dismissed, according to the city attorney, "in the interests of justice."
Attorney Comments:
"I detest the traffic cameras. There are so many problems with them it is hard to know where to begin. However, I am writing about this case because every once in a while, you get a sweet victory for a client and the client doesn't really fully appreciate how sweet the victory is. Anytime the government is going to issue one of these garbage traffic cam tickets, they are supposed to be able to prove certain legal requirements. In other words, the law allows these cameras but only if certain requirements are met. Of course, the cities that operate these cameras are likely not being diligent in making sure the requirements are being met because most people who get the tickets just pay them.
In a separate case for a separate client we had been litigating these requirements. Evidence came out in this other case that the city had been unlawfully issuing these tickets for a period of time. When that evidence came out in this other case, I was given the dismissal for my client in this case. This client had been issued one of the unlawful tickets. The city knew I had this information, so the case was dismissed. Of course, this is just my opinion because the case being "dismissed in the interest of justice" is deliberately vague and my specific inquiry about why this client's case was dismissed went unanswered.
I wonder how many other drivers were issued these tickets unlawfully that just paid them because they didn't know any better and didn't have an attorney willing to fight for them?
Or do you think the city was just going to voluntarily agree to give back their money and/or agree to dismiss them without request? Yeah………I'm sure that is what they did."
