Felony Assault of a Teenager

Case Summary:
The defendant was charged with felony Assault. The charges resulted out of an incident wherein the government accused the defendant of having assaulted his teenage child. The defendant's family was a "mixed" family (step-siblings, half-siblings, etc.) and there was some strained relationships between the siblings and between the teenage daughter and the defendant. During an incident where the family living arrangement was going through changes and tensions were high the teenage daughter got involved in an argument with another sibling. That argument turned physical. The defendant sought to intervene in the interaction and ultimately there was some physical exchange between the defendant and the teenage daughter. The defendant pled to misdemeanor Harassment but received no probation, no fine, and no jail.

Attorney Comment:
"This was a tough case because of the negative impact it had on all the family relationships. The teenage daughter was a loose cannon and multiple witnesses described her as being out of control. That was particularly true on that day during this incident. The daughter had already assaulted one of the other children. When my client intervened it was to try and change the daughter's attitude and stop the behavior. The teenage daughter had been cursing and saying a laundry list of foul language and insults towards various family members, including my client. As tensions were high, my client became physical with the teenage daughter to stop her abusive, both physical and emotional, behavior towards everyone else. We were able to negotiate a misdemeanor resolution to avoid risking a felony conviction here and my client was pleased to be done with it so he could get back to taking care of his family."
