Driving Under The Influence
The defendant was charged with a single count of felony driving under the influence of intoxicants (DUII). A person called in reporting that a motorist appeared to be driving erratically. A description of the vehicle and direction of travel was given. The police later contacted the reported vehicle disabled on the highway. Police made contact with the defendant and a DUII investigation was conducted and the defendant was subsequently arrested for DUII. The defendant pled guilty to felony DUII and was sentenced to bench probation and 90 days jail.
"This case was pretty straightforward. However, the outcome for my client ended up being better than what most DUII cases are. A 3rd DUII in Oregon is a felony and as such would normally be accompanied by supervised probation and 90 days in jail. In this case my client was pleased that we were able to negotiate a resolution that included bench probation (as opposed to supervised probation) and home incarceration (instead of jail). My client was immediately able to return to his home, which was out of state, without having to go through the hassle of transferring probation or serving any additional time incarcerated."
