Dash Cam Gone Viral
The Defendant was cited with careless driving. The citation arose out of an incident where the Defendant passed another vehicle while traveling in a school zone. The Defendant made a motion to dismiss the citation and the citation was dismissed because it was not lawfully issued.
"I don't regularly write about traffic citations, but this one was unique and fun. A citizen complainant, who was also a member of a local social media group (known for their nonsensical obsession with wanting to be law enforcement) posted a dash camera video of a vehicle passing the complainant's vehicle in a school zone. This complainant went to social media to politically pressure law enforcement to issue a citation purely based upon the video footage. At trial we challenged the lawfulness of the officer having issued the citation and succeeded. The citation was dismissed. I would encourage the citizen complainant to perhaps get a life of their own and stop looking for attention on social media."
