Completing the State's Job
Case Summary:
Defendant was charged with a single count of Menacing. The charge arose out of an incident wherein a 3rd party called the police because there had been a disturbance. The police came and were told two different narratives about what had happened. The police, based upon the different narratives they had been given and because there is a societal basis against men in these situations, arrested Defendant. Ultimately the case was dismissed against my client.
Attorney Comments:
My client adamantly denied doing anything to the alleged victim. After I reviewed the initial discovery that was sent to me it was clear that there were items missing, including the body cam footage of the officer(s) when they responded to the call. I made a request for the body cam footage. Shortly after that I received an email from the State that they had reviewed the footage and were going to dismiss the case. This case highlights the fact that the State, even though they have massive resources, don't always review all of the materials that they have before they make a decision to accuse someone of a crime. Often, as a defense attorney, much of my job is completing the investigation the State should have done in the first place.
