Breath Test Refusal
The petitioner was alleged to have refused to take a breath test after being arrested for a DUI. Petitioner timely filed a request contesting the 1 year suspension that the DMV was going to impose for the alleged refusal. The hearing was scheduled and immediately reset per the Officer claiming unavailability.
"On the day of the hearing we showed up and challenged the resetting of the original hearing date. Because the second hearing date was outside the mandatory 30 day period for the hearing we challenged the appropriateness of resetting the hearing. The Administrative Law Judge agreed that it was not a justifiable request and vacated the proposed suspension of my client's license."
