Case Summary:
The defendant was charged with Assault 4, Harassment, and Disorderly Conduct 2.The charges arose from an incident in which the defendant and another man were engaged in a verbal exchange that the defendant turned physical once the other man called him a name. The defendant pled guilty to Harassment as a violation and had to pay a fine.

The alleged victim in this case was not a victim at all. The alleged victim had a criminal history a mile long and was being disparaging to my client. Add to that that my client had a terminal and degenerative condition that was impairing his judgment and the recipe was what occurred. Fortunately, we were able to provide medical documentation of my client's condition and had a Deputy District Attorney that was reasonable. A plea to a violation level Harassment was a reasonable and just outcome under these circumstances.
